Terms of Use

These Terms of Use govern your access to and use of Top Health's website (the "Site"). Capitalized terms not defined here have the meaning given in our published account documentation. By using the Site, you agree to these terms. If you do not agree, you should not use the Site.

The Site is informational. Nothing on it constitutes (i) a sale of pharmaceuticals or medical supplies to the general public; (ii) clinical, legal, regulatory, or financial advice; or (iii) an offer to provide such advice. All transactions for regulated products are made through executed customer agreements with a licensed Top Health entity.

We may update these terms at any time. Continued use of the Site after a change is acceptance of the revised terms. If a revision is not acceptable to you, your only remedy is to stop using the Site.

Licensed Customers Only

Account access and ordering features on this Site are reserved for licensed healthcare providers, pharmacies, hospitals, and clinics with a current Top Health account. Identity verification, licensure verification, and credit checks apply.

Do not share your account credentials. You are responsible for activity under your account. If you suspect a credential has been compromised, notify orders@tophealth.example without delay.

Regulated Products

Top Health distributes prescription and over-the-counter medications, controlled substances, biologics, cold-chain products, and medical supplies. All distribution is performed under federal and state licensure and the Drug Supply Chain Security Act (DSCSA).

We do not ship regulated products to consumers. We do not split orders below labeled minimums. We do not bypass the DEA Form 222 or other required documentation under any circumstance.

Pricing and Availability

Pricing on the Site, in quotes, and in catalog feeds is indicative only and may change with manufacturer adjustments, allocation status, and market conditions. The price at the time of order confirmation is what governs the transaction.

When a product is shown as "Low" or "Backorder," that status reflects our best information at publish time. Allocation is managed to protect existing customer orders. Order early when you can.

Returns and Recalls

Returns are accepted in accordance with the executed customer agreement and applicable manufacturer return policies. Many regulated products are non-returnable for safety and traceability reasons.

Recalls are communicated directly to affected customers using the contact information on file. We expect customers to acknowledge recall notices promptly and remove affected lots from active inventory.

Third-Party Sites

The Site may link to external sites we do not operate ("External Sites"). We do not endorse External Site content and we are not responsible for it. Use of an External Site is at your own risk and governed by its own terms.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product-level warranties — where they exist — are provided by the original manufacturer and pass through to the buyer of record. Top Health is not responsible for off-label use of any product.

Limitation of Liability

Top Health is not liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Site. Where any portion of this limitation is unenforceable in your jurisdiction, the remainder still applies.

Governing Law

These terms are governed by the laws of the State of Illinois. Disputes will be heard in the state or federal courts in Cook County, Illinois. Both parties waive any objection to venue in those courts.
